Estate Agents policy cover

The vast majority of Professional Indemnity Policies for Property Professionals will provide full civil liability cover for claims arising from professional services carried out by the firm. Policies will typically extend cover to include (where relevant) cover for awards made by the Ombudsman for Estate Agents Scheme, the Surveyors and Arbitration Scheme and adjudications made under the Housing Grants Construction and Regeneration Act 1996.

You would normally expect to find that your professional indemnity policy will include cover in respect of defence costs – for example those incurred in dealing with investigation and defence of proceedings brought under the Health and Safety at Work Act, The Estate Agents Act and The Construction (Design and Management) Regulations 1994. (You should check to ensure that your policy does include this cover.)

Most polices will include compensation for court attendance in connection with a claim and cover for costs incurred for representation at tribunals and hearings.

There are a range of cover extensions which are provided normally as standard and these would include cover for Employee dishonesty – loss of money or property (other than that of employees) as a result of an employee’s dishonesty, Loss of documents – costs incurred replacing or restoring documents.
